Agents Responsibilities towards YOU! Duty of Obedience 4 of 6

This article is a 6 part series breaking down an agents fiduciary relationship with his or her client.

Hello there! You guessed it! For the fourth time I would like to reiterate the following:

An agent has certain responsibilities owed to his/her client that must be followed by law. Consider these responsibilities, or “fiduciary duties”, as the agents constitution and your bill of rights. An agents fiduciary duties encompass:  the duties of care, confidentiality, loyalty, obedience, accounting, and disclosure.

Now in the last article I briefly spoke about the relationship between you and your agent is in fact a “two way street”. Now this duty magnifies that quote to the umpteenth degree.

The duty of obedience is very brief but extremely important on the case of both parties involved.

The duty of obedience obligates the agent to obey the clients instructions in conformity with the contract. The agent can deny any request that is unethical and/or unlawful.

Asking the agent for example to make the property unavailable to certain demographics and available to others is both unlawful and unethical. Please don’t put an agent under these circumstances. Most are advised to walk  the other way if they suspect that you will ask him/her to perform an illegal task.

Again regarding anything else, the agent must follow through with your requests. Such as presenting and showing all present offers for example (even if it means a smaller commission…dum dum duuuuummmm).

Next we will discuss the agents duty of accounting.
